Classic garden grabbing reason for refusal overturned on appeal as sensible use of surplus and sustainable land by Inspector at appeal
Globe has successfully gained planning permission for the development of a generous area of land off Lincoln Road in North Hykeham that was rejected by the Council as an example of garden grabbing. The key issues relate to whether the proposed single dwelling would result in any adverse impacts on neighbouring properties or impact on the established character of the area. The Council sought to preclude development on the grounds that the land was a green field site in terms of national guidance and, as an example of garden grabbing, should be resisted. However, the Inspector found it to be consistent with other development in the locality, concluded that its development would have no detrimental impacts and, as it was a well located site within a sustainable location with access to all services, was simply an example of sustainable development.
